1. Acceptance of Terms

By accessing the SunSecure Tech website or engaging any of our cybersecurity, AI productivity, or managed security services, you agree to be bound by these Terms of Use. If you do not agree, please discontinue use immediately.

These Terms apply to all visitors and clients. SunSecure reserves the right to amend these Terms at any time; continued use constitutes acceptance of updated Terms.

2. Our Services

SunSecure Tech provides managed services including:

• Managed Cyber Security: Alignment with the ACSC Essential Eight, endpoint protection, and patch management.
• AI Productivity & Automation: Deployment of “Company Brain” internal assistants, automated note-taking, and workflow integration.
• Strategic Governance: Support for Australian Privacy Act compliance and industry-specific security standards.
• Data Resilience: Automated encrypted backups and recovery solutions.
• Intelligent Engagement: AI-driven voice and booking systems.

3. Australian Consumer Law & SME Protections

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled:

•To cancel your service contract with us; and
•To a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time.

4. Client Responsibilities

To ensure effective delivery, you agree to:

• Provide accurate information regarding your IT environment.
• Grant necessary administrative access as defined in your Service Agreement.
• Ensure all staff comply with security protocols (e.g., MFA requirements).
• Promptly notify SunSecure of any suspected security breaches or environment changes.

5. Acceptable Use & AI Integrity

You must use our services only for lawful purposes. You specifically agree not to:

• Use SunSecure AI tools to generate defamatory, misleading, or infringing content.
• Attempt to “prompt-inject” or reverse-engineer SunSecure’s proprietary AI logic or security configurations.
• Use our services to facilitate unauthorized surveillance or data scraping.

6. Intellectual Property

SunSecure Tech implements solutions using third-party platforms. While the underlying software belongs to those providers, any custom configurations, proprietary prompts, automated workflows, and “Company Brain” structures designed by SunSecure remain the intellectual property of SunSecure Tech. Clients are granted a right to use these configurations for the duration of their Service Agreement.

7. Privacy & Data Sovereignty

SunSecure complies with the Privacy Act 1988 (Cth) and the 2024/25 Australian Privacy Reforms.

• Data Location: We prioritize Australian-based data residency where technically feasible.
• Sub-Processors: We use secure third-party platforms. By using our services, you consent to the processing of data by these providers under our managed security configurations.

8. Third-Party AI Services

8.1 Use of Third-Party Models

SunSecure Tech integrates third-party Artificial Intelligence (“Third-Party AI”) into its productivity suites. You acknowledge that SunSecure does not own, develop, or control the underlying AI models. Consequently:

• Service Availability: We are not liable for outages or changes in functionality dictated by the Third-Party AI providers.
• Output Accuracy: AI outputs are generated by third-party models. SunSecure does not warrant the accuracy, bias-free nature, or correctness of these outputs.
• Human Oversight: All AI-generated content (emails, summaries, responses) must be reviewed by the Client before being relied upon for business or legal purposes.

8.2 Data Handling in AI

By using our AI suites, you acknowledge that your data may be processed by third-party AI providers in accordance with their respective privacy policies. SunSecure configures these tools using “Enterprise” or “API” settings where available to minimize data retention for model training, but cannot override the core terms of the third-party providers

9. Disclaimer of Warranties

While we apply best-practice frameworks (including the ACSC Essential Eight), the nature of the 2026 threat landscape means that no security solution can guarantee 100% protection. SunSecure provides its services as a risk-reduction strategy. We do not warrant that our services will be entirely immune from zero-day exploits or sophisticated state-sponsored cyber-attacks.

10. Limitation of Liability

• Direct Loss: To the extent permitted by the ACL, SunSecure’s total liability is limited to the fees paid by you in the three (3) months preceding the claim.
• No Indirect Loss: Neither party is liable for indirect or consequential loss (including loss of profit or reputation) arising from a cyber incident, provided SunSecure has acted with “due care and skill” as defined by Australian law.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia.

2. Our Services

SunSecure Tech provides the following managed services to businesses:

•Core Cyber Protection: 24/7 endpoint protection, SOC-assisted monitoring, email security, and patch management
•Threat Intelligence & Incident Response: human-backed threat analysis and real-time neutralisation
•Strategic Governance: compliance support aligned with internationally recognised cybersecurity and privacy standards
•AI Productivity & Automation: AI helpdesk assistants, ticket triage, and workflow automation
•Data Protection: automated backups, immutable storage, and encryption solutions

Service details, inclusions, and pricing are governed by the specific Service Agreement or Statement of Work entered into with each client.

3. Eligibility

Our services are intended for businesses and organisations. By engaging SunSecure, you represent that you are authorised to act on behalf of your organisation and that your organisation operates in compliance with all applicable laws in your jurisdiction.

4. Acceptable Use

You agree to use our website and services only for lawful purposes. You must not:

•Use our services to facilitate, conceal, or assist any illegal activity
•Attempt to gain unauthorised access to our systems, networks, or client data
•Reverse engineer, decompile, or tamper with any SunSecure technology or software
•Introduce malware, viruses, or any malicious code into our systems
•Misrepresent your identity or your organisation’s details when engaging our services
•Use our AI tools to generate misleading, harmful, or unlawful content

5. Client Responsibilities

To enable effective service delivery, you agree to:

•Provide accurate and up-to-date information about your systems and environment
•Grant SunSecure necessary access to systems and networks as agreed in your Service Agreement
•Maintain appropriate authorisation for SunSecure to perform security monitoring and testing on your systems
•Promptly notify SunSecure of any changes to your IT environment that may affect service delivery
•Ensure all users within your organisation comply with these Terms and any additional service-specific policies

6. Intellectual Property

All content on the SunSecure website, including text, graphics, logos, service methodologies, AI tools, and documentation, is the intellectual property of SunSecure Tech or its licensors and is protected under applicable copyright and intellectual property laws.

You may not reproduce, distribute, adapt, or republish any SunSecure content without prior written permission. Nothing in these Terms grants you any licence to use SunSecure’s trademarks, branding, or proprietary tools outside the scope of your Service Agreement.

7. Confidentiality

Both parties agree to maintain the confidentiality of all non-public information exchanged in connection with SunSecure’s services, including security assessments, vulnerability reports, incident findings, and business information. This obligation survives the termination of any service engagement.

8. AI Tools — Specific Terms

8.1 Limitations of AI Outputs

Where SunSecure deploys AI-powered tools as part of your service:

•AI outputs are provided as assistance only and do not constitute professional legal, financial, medical, or security advice
•You remain responsible for all decisions made using AI-generated outputs
•SunSecure does not guarantee the accuracy, completeness, or fitness for purpose of AI-generated content

8.2 AI Compliance

•Your use of AI tools must comply with all applicable laws in your jurisdiction
•SunSecure will notify you of any material changes to AI tool functionality that may affect your operations

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, SunSecure provides its website and services on an “as available” basis. While we apply best-in-class security practices, we do not warrant that our services will be uninterrupted, error-free, or completely immune to cyber threats. No cybersecurity solution can guarantee 100% protection against all threats.

10. Limitation of Liability

Direct Damages Cap

To the maximum extent permitted by law, SunSecure’s liability to you for any loss or damage arising from your use of our services is limited to the total fees paid by you to SunSecure in the three (3) months preceding the event giving rise to the claim.

Exclusion of Consequential Loss

SunSecure is not liable for indirect, consequential, incidental, or punitive damages. Nothing in these Terms excludes any right or remedy that cannot be excluded under applicable consumer protection laws.

11. Indemnification

You agree to indemnify and hold SunSecure, its directors, employees, and partners harmless from any claims, losses, damages, or expenses (including legal fees) arising from your breach of these Terms, your misuse of our services, or your violation of any applicable law.

12. Termination

Either party may terminate a service engagement in accordance with the terms of the applicable Service Agreement. SunSecure reserves the right to immediately suspend or terminate your access to our services if you breach these Terms, engage in unlawful activity, or pose a risk to the security of our systems or other clients.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which SunSecure Tech operates. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.

14. Changes to These Terms

SunSecure may update these Terms of Use from time to time. We will notify you of material changes by posting an updated version on our website with a revised effective date. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.
